Terms of Use of the Hirosaki City Free Public Wi-Fi Service

Article 1 (Objective)
 The following terms of use specify rules required to use the Wi-Fi Internet access service

(hereinafter referred to as the "public Wi-Fi service") developed by Hirosaki City (the City) with the aim of improving the ease of obtaining and providing information for the residents of the City and tourists visiting the City:
 
Article 2 (Service Content)
 Users of the public Wi-Fi service are able to access the Hirosaki Kanko Gekijo portal site and the Internet via Wi-Fi access as specified in the following article.
 
Article 3 (Facilities and Areas with Wi-Fi Access and Service Hours)
 Facilities and areas with Wi-Fi access and service hours are listed in the table provided below. Service hours may change depending on scheduled special events, etc.
 
Article 4 (User Eligibility)
 The public Wi-Fi service is limited to individual users and is not available to organizations, including corporations. However, this provision does not apply to organizations deemed by the City to require
 the service.
 
Article 5 (Use of the Public Wi-Fi Service)
 Users of the public Wi-Fi service must provide the following:
 (1)Smartphone with Wi-Fi features and other necessary devices

(2)Power sources for Smartphone and peripheral devices

(3)Web browsers and other necessary software

 2 The public Wi-Fi service is available free of charge.
 
Article 6 (Procedure for Using the Service)
 Applicants who wish to use the public Wi-Fi service must agree to these terms of use, and must register for the service after entering their user IDs; they must also answer the questionnaire on the browser screen displayed when connecting to the service.
 
Article 7 (Approval of Use)
 Applicants who have applied for the service following the procedure outlined in the preceding

article shall be given the approval to use the service.
 2. Applicants who have been given approval as stated in the preceding paragraph shall be able to access the Internet using their registered user IDs.
 
Article 8 (Valid Period of User IDs)
 User IDs shall be valid for 90 days starting from their registration date. Users who wish to use the service after their IDs have expired must follow the procedure specified in Article 6.
 
Article 9 (Management of User IDs)
 Users should not lend or give their user IDs for the public Wi-Fi service to other individuals.
 2. Users must bear full responsibility for any damage resulting from the inappropriate management of their IDs, errors in the use of their IDs or unauthorized access by third parties. The City cannot assume any responsible for such damage.
 
Article 10 (Collection of Usage Information and the Purpose of Use of Such Information)
 For the purposes shown below, the City collects information on public Wi-Fi service usage time, access points and terminal identification (MAC addresses) as access logs when users use the service.
 (1) To conduct surveys on the number of users of the public Wi-Fi service

(2) To perform analysis in order to improve the public Wi-Fi service and consider new services

 
Article 11 (Revocation of User IDs)
 The user IDs of users who fall under any of the following categories shall be suspended or revoked immediately without prior notice:
 (1) Users who have committed acts prohibited in Article 12

(2) Users who have committed acts other than those mentioned in the preceding paragraph that are in violation of these terms of use

(3) Users who are deemed inappropriate by the City for reasons other than the above

 
Article 12 (Prohibitions)
 Users should not commit the following acts:
 (1) Acts that violate or may violate the privacy or other rights of other users or third parties

(2) Acts other than those mentioned in the preceding paragraph that cause or may cause disadvantages or damage to other users or to the City

(3) Acts that defame others

(4) Acts that offend or may offend public order and morals, or acts that provide information that is offensive to public order and morals

(5) Criminal acts, or acts that lead to or may lead to criminal acts

(6) Election campaigns or other similar acts, irrespective of election periods

(7) Sex-related, religious or political acts

(8) Acts that use or provide harmful programs, including computer viruses, via or in connection with Wi-Fi access

(9) Acts that send large amounts of e-mail to a specified or unspecified number of people for online sales, multi-level marketing, business opportunity sales (Ponzi schemes, etc.) or other similar purposes

(10) Acts other than those mentioned in the preceding paragraphs that are or may be in violation of laws, and acts that are deemed as inappropriate by the City

 2. Users must bear full legal responsibility for any damage to the City,users or third parties caused by acts that fall under the categories described in the preceding paragraphs, even after their service periods have expired. The City cannot assume any responsibility for such damage.
 
Article 13 (Suspension of Use)
 The City may suspend the use of the public Wi-Fi service without notice to users under the circumstances specified in the following paragraphs:
 (1) Periodic or emergency maintenance of construction of public Wi-Fi systems infrastructure

(2) When the public Wi-Fi service cannot be provided as usual due to riots, disturbances, strikes, earthquakes, volcanic eruptions, tsunamis,fires, blackouts or other emergencies

(3) Malfunctions of facilities or networks related to public Wi-Fi systems, or other compelling circumstances

(4) Circumstances other than those mentioned in the preceding three paragraphs that are deemed by the City to require temporary suspension of the service for the proper management of the public Wi-Fi service

 2. The City cannot assume any responsibility for any damage to users or third parties caused by the suspension of the public Wi-Fi service,regardless of the reason.
 
Article 14 (Disclaimers)
 The City does not guarantee the validity, accuracy, certainty or usefulness of the public Wi-Fi service or of the information that users obtain through the public Wi-Fi service.
 2. The City cannot assume any responsibility for damage to users resulting from the following circumstances: the provision of the public Wi-Fi service and delays, changes, suspension or termination of the service; loss of information registered, provided or collected by users via the public Wi-Fi service; damage, data loss and information exposure due to computer virus infection of users' computers; or other causes related to the public Wi-Fi service.
 3. Users must bear all the expenses for the pay services that they use on the Internet, regardless of the reason.
 4. Users must configure settings for devices required to access the
 public Wi-Fi service. The City cannot assume any responsibility for the unavailability of the public Wi-Fi service due to the type of devices, basic software, applications and Web browsers used to access the Wi-Fi service.
 5. The City cannot assume any responsibility for conflicts between users or between users and third parties resulting from the use of the public Wi-Fi service.
 6. The City may restrict access (filtering) to specific websites in order to facilitate the appropriate use of the public Wi-Fi service.
 
Article 15 (Revisions of the Terms of Use)
 The City may make revisions to these terms of use without the consent of users.

 The above rules shall come into force on March 31, 2012.

 The above rules shall come into force on August 01, 2012.
